Nosh AI is an artificial intelligence-powered application that provides personalized meal recommendations based on your dietary preferences, health information, location, and other inputs you provide. The App is designed to help reduce food decision fatigue by suggesting meals tailored to your needs.

You must be at least 18 (eighteen) years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old, are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and are eligible in accordance with applicable laws to enter into a binding contract. If you are under 18 years of age, you may only use the App with the explicit consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

To access certain features of the App, you may need to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that contain false or misleading information.

4.1 Permitted Use

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.

4.2 Prohibited Conduct

You agree not to:

The meal recommendations, nutritional information, and other content provided by Nosh AI are generated by artificial intelligence systems. You acknowledge and agree that:

• AI-generated recommendations may not always be accurate, complete, or suitable for your specific circumstances
• The App may occasionally suggest meals that conflict with your stated preferences or restrictions due to limitations in AI technology
• You are solely responsible for verifying that any meal or ingredient is safe for your consumption, particularly if you have allergies, intolerances, or medical conditions
• Nutritional estimates provided by the App are approximate and should not be relied upon for medical or clinical dietary management
• The quality and relevance of recommendations may vary and improve over time as the AI learns from usage patterns

Your health and safety are important to us. Please note the following:

All rights, title, and interest in and to the App — including its design, code, AI models, algorithms, graphics, logos, trademarks, and content — are and remain the property of Nosh AI and its licensors. These Terms do not grant you any rights to use our trademarks, logos, or branding without prior written consent.

Any feedback, suggestions, or ideas you provide regarding the App may be used by us without any obligation to compensate you.

You retain ownership of any content you submit to the App (such as dietary preferences, health data, and feedback). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store such content solely for the purpose of providing and improving the Services.

The App may integrate with or contain links to third-party services, websites, or content. We are not responsible for the availability, accuracy, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies.

Certain features of the App may require a paid subscription or one-time purchase. If applicable:

• Subscription fees and billing cycles will be clearly disclosed before purchase
• Payments are processed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your device’s app store settings or through the App’s account settings, as applicable
• For payments processed via the App Store or Play Store, refunds are handled in accordance with their respective refund policies
• Refunds are handled in accordance with the refund policy of the Apple App Store or Google Play Store, as applicable
• In the event of any payment dispute, the relevant app store billing and support process will govern resolution

10.1 App Store Billing

When you make payments through the Apple App Store or Google Play Store, your payment information is collected and processed directly by the relevant app store. We do not store your complete payment credentials on our servers. Your use of these payment services is governed by the relevant app store’s billing terms and privacy policy.

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED CONTENT, MEAL RECOMMENDATIONS, OR NUTRITIONAL INFORMATION

• Loss of profits, data, or goodwill
• Personal injury or health issues arising from reliance on AI-generated meal recommendations
• Allergic reactions or adverse health effects resulting from following the App’s suggestions
• Service interruptions or data loss
• Any damages arising from unauthorized access to your account or data

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 5,000 (FIVE THOUSAND INDIAN RUPEES), WHICHEVER IS LESSER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify and hold harmless Nosh AI, its developer, and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of any third party.

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App and delete your account at any time.

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account data in accordance with our Privacy Policy
• Provisions of these Terms that by their nature should survive termination will remain in effect (including Sections 7, 11, 12, 13, 16, and 17)

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, please stop using the App.

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, the Consumer Protection Act, 2019, and any amendments thereto, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts located in Bengaluru, India.

In accordance with the Information Technology Act, 2000 and the rules made thereunder, the name and contact details of the Grievance Officer are provided below. Any complaints, concerns, or grievances regarding the App, Services, or these Terms may be directed to:

The Grievance Officer shall acknowledge your complaint within 24 hours and resolve it within 15 days of receipt.

By registering on the App and providing your email address and/or phone number, you expressly consent to receiving service-related communications from us, including account notifications, meal reminders, updates, and promotional messages. You may opt out of promotional communications at any time through the App settings or by contacting us. By providing your phone number, you grant us permission to contact you via telephone, SMS, email, or push notifications, and you hold us indemnified against any liabilities including penalties or damages in case your mobile number is registered with the Do Not Disturb (DND) / Do Not Call (DNC) registry.

You acknowledge that your use of the App requires an internet connection and that applicable network and data charges may be incurred through your use of the App. You are solely responsible for any and all such charges, and we shall have no liability to you in respect of such charges.
